This Notice describes how your health information may be used and disclosed, how you may access your information, and the responsibilities of Wide Awake Therapy | Christian Counseling, PLLC regarding the privacy of your protected health information.

Wide Awake Therapy is required by law to maintain the privacy and security of your protected health information, provide you with this Notice, and follow the privacy practices described here. 

You have the right to:

Access your health record.
You may request to inspect or receive an electronic or paper copy of your health record and other health information maintained about you. In most circumstances, access will be provided within the time required by law. Reasonable, cost-based fees may apply.

Request corrections.
If you believe information in your record is incorrect or incomplete, you may request an amendment. A request may be denied in certain circumstances, but you will be provided an explanation when required by law.

Request confidential communications.
You may ask to be contacted in a particular way or at a particular location. Reasonable requests will be honored.

Request restrictions.
You may ask that certain information not be used or disclosed for treatment, payment, or health-care operations. Wide Awake Therapy is not always required to agree to such requests. When you pay in full out of pocket for a service, however, you may request that information about that service not be disclosed to your health plan for payment or health-care operations unless disclosure is otherwise required by law.

Receive an accounting of certain disclosures.
You may request information about certain disclosures of your protected health information made during the six years preceding your request. Some disclosures—including many made for treatment, payment, health-care operations, or at your direction—are not included in this accounting. 

Receive a copy of this Notice.
You may request a paper or electronic copy of this Notice at any time.

Choose someone to act for you.
If another individual has legal authority to act as your personal representative, that person may exercise applicable privacy rights on your behalf after their authority has been verified.

File a complaint.
If you believe your privacy rights have been violated, you may file a complaint with Wide Awake Therapy or with the U.S. Department of Health and Human Services Office for Civil Rights. You will not be retaliated against for filing a complaint. 

In certain circumstances, you may tell us how you would like your information shared, including whether information may be shared with family members, close friends, or others involved in your care or payment for your care.

Except as otherwise permitted or required by law, written authorization is generally required for:

• Most uses and disclosures of psychotherapy notes; 
• Marketing purposes; and 
• The sale of your protected health information. 

You may revoke a written authorization as permitted by law. 

Your protected health information may be used or disclosed without separate authorization when permitted or required by law, including for the following purposes:

Treatment.
Information may be used or shared with other health-care professionals involved in your treatment when appropriate and legally permitted.

Health-care operations.
Information may be used to operate the practice, coordinate services, improve care, conduct necessary administrative activities, and contact you regarding your care.

Payment.
Information may be used or disclosed to obtain payment for services, including communication with health plans or other entities responsible for payment.

Information may also be disclosed when permitted or required by law for certain purposes involving public health and safety, suspected abuse or neglect, health oversight, workers’ compensation, law enforcement, legal proceedings, medical examiners or funeral directors, and other government functions.

Any disclosure will be limited by applicable federal and Texas law. 

Texas law provides additional confidentiality protections for communications between a patient and a mental-health professional and for records relating to mental-health treatment.

Wide Awake Therapy will protect counseling communications and records in accordance with applicable Texas and federal law and will disclose such information only when authorized, permitted, or required by law. 

Psychotherapy notes, when maintained separately from the clinical record and meeting the applicable legal definition, receive additional privacy protections. Most uses and disclosures of psychotherapy notes require your written authorization unless an exception under applicable law applies. 

To the extent Wide Awake Therapy creates, receives, or maintains substance use disorder patient records that are protected under 42 CFR Part 2, additional federal confidentiality protections may apply.

Such records generally may not be used or disclosed in civil, criminal, administrative, or legislative investigations or proceedings against you without your written consent or appropriate legal authorization as required by federal law. HHS requires HIPAA covered providers to include applicable Part 2 information in their Notice of Privacy Practices beginning February 16, 2026.

Wide Awake Therapy is required to:

• Maintain the privacy and security of your protected health information; 
• Follow the duties and privacy practices described in the current Notice; 
• Provide you with a copy of this Notice upon request; 
• Notify you as required by law if a breach occurs that may have compromised the privacy or security of your information; and 
• Obtain your written authorization before using or disclosing your information for purposes not otherwise permitted by law. 

If you provide written authorization, you may revoke it in writing as permitted by law. 

Wide Awake Therapy may change the terms of this Notice and may make the revised Notice effective for all protected health information maintained by the practice.

The current Notice will be available upon request and posted on the Wide Awake Therapy website.
