Confidentiality, Privacy & Client Rights

Confidentiality, Privacy & Client Rights

Wide Awake Therapy | Christian Counseling, PLLC is committed to protecting the privacy and confidentiality of your health information. Counseling records and communications are protected by applicable federal and Texas law.

This page provides a general overview of confidentiality, limits to confidentiality, client rights, and privacy practices. For a complete description of HIPAA privacy rights and permitted uses and disclosures of protected health information, please review the Notice of Privacy Practices.

VIEW NOTICE OF PRIVACY PRACTICES

Limits of Confidentiality

Counseling communications and records are confidential. Information may be disclosed without your written authorization only when permitted or required by applicable law. This may include certain circumstances involving suspected abuse or neglect, serious safety concerns, health oversight activities, workers’ compensation, legal proceedings, or other disclosures specifically authorized or required by law.

When disclosure is required or permitted, I will limit the information disclosed to what is legally appropriate and necessary.

Insurance and Payment

If you choose to use insurance, protected health information necessary for billing, payment, utilization review, or other permitted health-plan functions may be disclosed as allowed by law. Separately maintained psychotherapy notes receive additional protections and generally require written authorization for disclosure unless a specific legal exception applies.

Business Associates

Wide Awake Therapy may use qualified third-party service providers to support functions such as billing, records management, technology, or other practice operations. When required, these entities enter into agreements designed to safeguard protected health information in accordance with applicable law.

Client Rights

Under applicable law, you have rights that may include access to certain health records, request amendments, request confidential communications, request certain restrictions, obtain an accounting of certain disclosures, receive a copy of the Notice of Privacy Practices, and file a privacy complaint without retaliation.

Participation in Counseling

Counseling is voluntary. You may ask questions about treatment, discuss alternatives, and choose to discontinue counseling. When clinically appropriate, we can discuss transition or referral options to support continuity of care.

Our Responsibilities

Wide Awake Therapy is required to protect the privacy and security of protected health information and to follow applicable federal and Texas confidentiality laws. The current Notice of Privacy Practices describes these obligations in greater detail.

Privacy Questions or Complaints

If you believe your privacy rights have been violated, you may contact Wide Awake Therapy or file a complaint with the U.S. Department of Health and Human Services Office for Civil Rights. You will not be retaliated against for filing a complaint.

Questions or complaints concerning professional counseling licensure may also be directed to the Texas Behavioral Health Executive Council. Please see the Client Rights & Access to Records page for current complaint information and instructions.
